Section 12
Right to take possession of land:

(1) After the notification as per sub-section (1) of section 9 is issued, after the complaint is settled as per sub-section (1) of section 11, and after the expiry of the deadline for making a complaint in case no complaint is filed, the local authority may, at any time, take the relevant land It can be given to the office or organization for which the land has been obtained after taking possession and after that the land can be used for the related work. After taking possession of the land in this way, the local authority shall notify the Nepal Government.

(2) Regardless of what is written in sub-section (1), if a house is also acquired when a land is acquired, if the owner of the house has lived in that house himself, he shall get it. If the amount of compensation has been determined, such a house shall not be occupied without paying 50 percent of it and if the amount of compensation has not been determined, the house shall not be occupied without providing the amount of reasonable compensation required for the purpose of shifting his residence to another place.
